Hardly an episode has changed the relationship between state and workers’ unions with such lasting effects as the amendment of § 116 of the Employment Promotion Act in 1986. An analysis of the political, particularly the parliamentary discourse in the context of the amendment shows that state actors justified the modification of the trade unions’ capacity to actwith maintaining the functional capability of collective negotiationswithout state intervention. The article discusses the different interpretations between government and trade unions regarding functioning collective negotiations, as well as the structural causes and institutional consequences of the revision.
