Based on a case study, this article argues that despite formal equality before the law, social inequality had a significant impact on criminal trials. Instead of identifying judges as being responsible for "class justice", I have analyzed the resources available on all parties involved. Accusations and testimonies were less dependent on a judicial logic of "truth" but more influenced by local power relations. Due to the public character of the "secret" preliminary examination and scientific assumptions about the credibility of witnesses, trials failed to compensate social inequalities, but reinforced and perpetuated them instead.
